These Terms of Service (“Terms”) govern your access to and use of the EBook ANVIL website, products, downloads, accounts, and related services (collectively, the “Services”). By visiting the Website, creating an account, or purchasing a product from EBook ANVIL, you agree to these Terms.

If you do not agree to these Terms, do not use the Services.

1. Who We Are

EBook ANVIL is operated by EBOOK ANVIL FORGED, UNIPESSOAL LDA, trading as EBook ANVIL, with registered address at Rua Fialho de Almeida nº14, 2º Esq., Escritório FH14 | 1070-129 Avenidas Novas | Lisboa | Portugal – NIPC/VAT: PT518289346, and contact email info@ebookanvil.com.

In these Terms, “EBook ANVIL,” “we,” “us,” and “our” refer to that legal entity.

2. Scope of These Terms

These Terms apply to:

the Website;
all digital products sold through the Website, including ebooks, digital art, and related downloadable files;
any account created on the Website;
any promotional campaign, coupon, or discount, unless separate terms state otherwise.

If a product page, license page, checkout page, or written agreement states terms that conflict with these Terms, the more specific terms will control for that product or transaction.

3. Eligibility and Account Responsibilities

You may use the Services only if you have legal capacity to enter into a binding contract under applicable law.

If you create an account, you are responsible for:

keeping your login credentials confidential;
restricting access to your account and devices;
all activity carried out through your account, except to the extent caused by our own fault.

You must provide accurate, current, and complete information when placing an order or creating an account.

We may suspend or close an account, or block access to downloads, if we reasonably believe that an account is being used in breach of these Terms, including account sharing, chargeback abuse, fraud, unauthorized distribution, or infringement of our intellectual property rights.

4. Digital Products Only

All products sold by EBook ANVIL are digital products only. No physical goods are sold or shipped unless a product page expressly states otherwise.

Product galleries may include illustrative images that show a digital artwork or ebook design displayed on physical items or in physical settings, such as frames, posters, canvases, apparel, mugs, device covers, desks, walls, or rooms. Those images are mockups and visual examples only.

Unless a product page expressly states otherwise, your purchase includes only the digital file or files described on the product page. No physical frame, print, device, accessory, or other item shown in a mockup is included.

5. Product Information, Technical Requirements, and Compatibility

We try to describe each product as accurately as possible. Product pages may include information such as file type, file size, image resolution, language, page count, and basic compatibility details.

You are responsible for having the hardware, software, internet access, storage space, and technical ability needed to access and use the purchased files.

Unless a product page states otherwise:

ebooks are sold for use on compatible reading devices or software;
digital art files are sold as downloadable image files for personal use under the license stated in these Terms or on the product page;
colors and print results may vary depending on printers, paper, inks, screens, calibration, and third-party print services.

Minor differences in color, brightness, cropping, or print output that result from a customer’s equipment, software, monitor settings, printer settings, paper choice, or print provider do not by themselves establish that a product is defective.

6. Orders, Pricing, Taxes, and Payment

By placing an order, you make an offer to purchase the selected digital product or products subject to these Terms. A contract is formed when we accept your order and make the digital product available for download or access.

All prices are shown in the currency displayed on the Website. Product pages may show a base product price. Any applicable VAT, sales tax, or similar charge will be shown to you before you place the order, where required by law.

You are responsible for any taxes, duties, or fees that apply to your purchase, except for taxes imposed on our own income.

Payment must be made through the payment methods made available at checkout. We may use third-party payment processors. We do not store your full payment card details.

We reserve the right to:

correct obvious pricing errors;
refuse or cancel orders affected by fraud, technical error, misuse of promotions, or suspected unlawful activity;
limit quantities or restrict purchases where reasonably necessary.

If we cancel an order before supply of the digital product, we will refund any amount paid for that order.

7. Delivery, Download Access, and Timing of Supply

Digital products are usually supplied immediately after successful payment, unless the product page states otherwise.

Supply may take place by one or more of the following methods:

direct download on the order confirmation page;
download link sent by email;
access through a customer account area;
another digital access method described at checkout or on the product page.

You are responsible for providing a valid email address and checking spam or junk folders.

If you do not receive access within a reasonable time after payment, you must contact us at info@ebookanvil.com so we can investigate and, where appropriate, re-supply the file or access link.

8. Right of Withdrawal for Digital Content

If you are a consumer and applicable law grants you a withdrawal right for distance contracts, that right does not apply, or is lost, once the supply of digital content not supplied on a tangible medium begins, provided that:

you expressly consent to immediate supply before the withdrawal period expires; and
you acknowledge that you lose your withdrawal right once supply begins.

For that reason, when you place an order for immediate download or immediate access, you will be asked at checkout to give express consent to immediate supply and to acknowledge the loss of the withdrawal right once supply begins.

If you do not give that consent, we may delay supply until the applicable withdrawal period has expired, or we may decline the order.

This Section does not limit any mandatory rights you may have under applicable consumer law if digital content is not supplied, is corrupted, materially differs from its description, or is otherwise non-conforming.

9. No General Refunds After Valid Supply of Non-Defective Digital Content

Because our products are digital, downloadable, and not returnable in the ordinary sense, all sales are final once a product has been validly supplied and no legal right to withdraw remains.

That said, this rule does not remove or limit any non-waivable rights you may have under applicable consumer law.

If your purchased digital product:

is not delivered;
cannot be downloaded due to our fault;
is corrupted or incomplete due to our fault;
materially differs from the product description; or
is otherwise non-conforming under applicable law,

please contact us at info@ebookanvil.com with your order details and a clear description of the issue. Where required by law, or where we consider it appropriate, we may re-supply the product, repair the issue, replace the file, grant a price reduction, or issue a refund.

10. License Grant

Unless a different license is expressly stated on the product page or in a separate written agreement, your purchase gives you a limited, non-exclusive, revocable, non-transferable, non-sublicensable license to use the purchased digital file solely for your own personal, non-commercial use.

10.1 Personal Use License for Digital Art

Under the default personal-use license, you may:

download and store the file for your personal use;
print the artwork for your own private display or enjoyment;
use a professional print service for a personal print job;
place the printed artwork on physical items for your own private use, such as wall art, posters, apparel, mugs, or similar personal items, provided that no sale, giveaway, distribution, or commercial use takes place.

Unless a product page states a different limit, any print authorization under the default personal-use license is for personal output only and does not grant commercial print rights, resale rights, or mass-production rights.

10.2 Personal Use License for Ebooks

Under the default personal-use license for ebooks, you may:

download the ebook for your own private reading;
store it on your own compatible devices;
make a reasonable backup copy for personal archival use, if permitted by applicable law.

11. Prohibited Uses

Except where mandatory law permits otherwise, you may not, and may not permit any third party to:

reproduce, sell, resell, license, sublicense, rent, lease, assign, transfer, gift, distribute, or commercially exploit any product or file;
upload, post, share, or redistribute any purchased file on websites, forums, cloud drives, social platforms, file-sharing services, torrent networks, marketplaces, or print-on-demand platforms;
use any purchased product or file in advertising, branding, social media marketing, paid campaigns, client work, merchandise, product packaging, templates, or business materials;
use any purchased file for print-on-demand, dropshipping, wholesale, retail sale, or any other commercial production or fulfillment model;
claim authorship, ownership, or exclusive rights in any purchased file or any derivative based on it;
remove, alter, or obscure any copyright notice, watermark, metadata, or proprietary notice;
copy, scrape, data-mine, or harvest content from the Website;
use our products, images, text, or metadata for machine learning, generative AI training, model fine-tuning, dataset creation, prompt libraries, or similar automated systems;
mint, tokenize, or use our products in connection with NFTs, blockchain assets, or similar digital asset systems;
use any product in any unlawful, defamatory, infringing, obscene, hateful, or deceptive manner.

12. Print Service Providers

If you use a third-party print service for a personal print permitted by your license, you must use reasonable efforts to instruct the print service to use the file only for that authorized print job and to delete the file after the job is complete.

No print shop, print broker, employee, contractor, or other third party receives any license from EBook ANVIL by virtue of your purchase, except the limited technical permission needed to complete the single authorized print job for your private use.

Any retention, reuse, duplication, resale, display, portfolio use, marketing use, or commercial reuse of the file by a print provider is prohibited unless we have given prior written permission.

13. Intellectual Property Rights

All Website content and all digital products sold through the Website, including ebooks, text, artwork, images, covers, layouts, previews, mockups, graphics, logos, trademarks, branding, downloadable files, and related materials, are owned by EBook ANVIL or used under valid license and are protected by copyright, trademark, and other applicable intellectual property laws.

Your purchase does not transfer to you any copyright, trademark, or other intellectual property right in the purchased file or in any part of the Website.

All rights not expressly granted to you are reserved by EBook ANVIL.

14. Infringement, Abuse, and Enforcement

Any unauthorized use of our products or Website content may result in one or more of the following actions:

suspension or termination of your account or download access;
revocation of your license;
takedown notices or platform complaints;
preservation of evidence;
demands to cease and desist;
claims for damages, injunctive relief, costs, and any other remedies available under applicable law.

15. Promotions, Coupons, and Newsletter Offers

We may run discounts, coupon campaigns, newsletter sign-up offers, order-bump offers, abandoned-cart reminders, or other promotions from time to time.

Unless a promotion expressly states otherwise:

promotions are subject to availability and may be changed or withdrawn at any time;
promotions cannot be redeemed for cash;
only one promotion or coupon may be used per order;
promotions cannot be combined with other discounts, coupon codes, or special pricing;
promotions do not apply retroactively to past purchases;
we may cancel a promotion or refuse redemption if we reasonably believe there is misuse, fraud, or technical abuse.

Any email marketing, newsletter subscription, or unsubscribe rights are governed by our Privacy Notice and applicable data-protection law, in addition to these Terms.

16.User Conduct on the Website

You agree not to:

use the Website in any way that violates any law or regulation;
interfere with or disrupt the Website, servers, security systems, or networks;
attempt unauthorized access to any account, system, or data;
introduce malware, harmful scripts, bots, or malicious code;
use automated means to access, scrape, monitor, or copy Website content without our prior written permission;
impersonate any person or entity, or misrepresent your affiliation with any person or entity.

17. Availability of the Website

We try to keep the Website available, secure, and functioning properly, but we do not promise uninterrupted or error-free operation.

The Website may be unavailable from time to time due to maintenance, updates, technical issues, security events, or causes outside our reasonable control.

18. Consumer Rights and Lack of Conformity

Nothing in these Terms excludes, limits, or waives any mandatory rights that consumers may have under applicable law.

If you are a consumer and a digital product is not supplied, is faulty, corrupted, inaccessible due to our fault, or otherwise lacks conformity under applicable law, you may have legal rights that can include re-supply, repair, replacement, price reduction, or termination of the contract, depending on the circumstances and the law that applies to your purchase.

19. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

Subject to the sentence above, to the fullest extent permitted by law:

we are not liable for indirect, incidental, special, consequential, or punitive damages;
we are not liable for loss of profits, loss of revenue, loss of business, loss of goodwill, loss of opportunity, or loss of data arising out of or related to the use of the Website or the purchase or use of any digital product;
our total aggregate liability arising out of or related to a specific order will not exceed the amount actually paid by you for that order.

We are not liable for loss caused by:

your device, browser, software, printer, email provider, internet connection, or storage limitations;
third-party payment processors, hosting providers, print services, or other third-party services outside our reasonable control;
your misuse of the product, file, or Website;
your failure to follow product instructions, compatibility notes, or technical requirements.

20. Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless EBook ANVIL and its officers, owners, contractors, service providers, and affiliates from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

your breach of these Terms;
your unlawful use of the Website or any digital product;
your infringement of any intellectual property or other right of any third party.

This Section does not apply to the extent a claim results from our own fault, unlawful conduct, or a right that cannot be waived under consumer law.

21. Suspension and Termination

We may suspend or terminate your access to all or part of the Services, with or without prior notice, if we reasonably believe that you have breached these Terms, acted fraudulently, misused the Services, infringed our rights, or created legal, technical, or security risk.

Termination of access does not affect:

rights and obligations accrued before termination;
payment obligations already due;
any provision of these Terms that by its nature should survive termination, including intellectual property, license restrictions, limitation of liability, indemnity, governing law, and dispute-related provisions.

22. Governing Law and Disputes

These Terms and any dispute, claim, or controversy arising out of or related to them, the Website, or any purchase from EBook ANVIL are governed by the laws of Portugal, without regard to conflict-of-law rules, except that if you are a consumer, this choice of law does not deprive you of the mandatory consumer protections granted to you by the law of the country in which you habitually reside.

If you are a consumer, you may also have the right to bring claims before the courts that are competent under applicable consumer-protection law.

If you are not a consumer, the courts of Lisboa, Portugal shall have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Services.

24. Privacy

25. Changes to These Terms

The version in force at the time of your order will apply to that order, unless a change is required by law or clearly benefits you as a consumer.

26. Severability

If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.

27. No Waiver

If we do not exercise or enforce any right or provision of these Terms, that does not operate as a waiver of that right or provision.

28. Entire Agreement

These Terms, together with any applicable product-page terms, license terms, checkout disclosures, Privacy Notice, Cookie Notice, and any written agreement signed by us, form the entire agreement between you and EBook ANVIL regarding the relevant purchase or use of the Services.
